JobDeck SaaS Agreement

The customer agreement for organizations that subscribe to or operate a JobDeck workspace.

Parties and Scope

This SaaS Agreement applies between Monument Software Group and the business customer or organization that creates, subscribes to, or uses a JobDeck workspace. Users who access the workspace are authorized users of that customer.

This agreement governs access to the hosted JobDeck software, related support, and customer data processing for business use.

Access Rights

Subject to this agreement, Monument Software Group grants the customer a limited, non-exclusive, non-transferable right for authorized users to access and use JobDeck for the customer's internal business operations.

The customer is responsible for authorized users, account administration, permissions, credentials, and all activity occurring within its workspace.

Customer Responsibilities

The customer must use JobDeck in compliance with applicable laws, maintain the accuracy and legality of customer data, obtain required consents, and prevent unauthorized access or use.

The customer may not resell JobDeck, circumvent limits, interfere with service security, introduce malicious code, or use the service to store or process unlawful material.

Customer Data and Ownership

As between the parties, the customer owns customer data entered into JobDeck. Monument Software Group owns JobDeck, including software, designs, workflows, documentation, know-how, and related intellectual property.

The customer grants Monument Software Group the rights needed to host, process, transmit, display, secure, back up, support, troubleshoot, and improve JobDeck.

Fees and Plans

Subscription tiers, seat limits, feature availability, pricing, and billing terms are provided during registration, on the pricing page, in an order form, or in another written agreement.

Unless a separate written agreement says otherwise, fees are non-refundable except where required by law, and paid access may be suspended or terminated for nonpayment.

Security, Support, and Availability

Monument Software Group will use commercially reasonable efforts to operate JobDeck securely and reliably. The customer remains responsible for endpoint security, user access controls, and appropriate internal use.

Support may be provided by email or other channels we make available. Support scope and response times may vary by plan or written agreement.

Confidentiality

Each party may receive non-public information from the other. The receiving party must use reasonable care to protect confidential information and use it only to perform or receive services under this agreement.

Confidentiality obligations do not apply to information that is public through no fault of the receiving party, independently developed, lawfully received from another source, or required to be disclosed by law.

Term and Termination

This agreement begins when the customer creates or uses a JobDeck workspace and continues until terminated. The customer may stop using the service or request deletion according to available account controls.

Monument Software Group may suspend or terminate access for material breach, security risk, unlawful use, nonpayment, or as otherwise permitted by law or written agreement.

Disclaimers and Liability

Except as expressly stated in a written agreement, JobDeck is provided as-is and as-available. Monument Software Group disclaims all implied warranties to the fullest extent permitted by law.

To the fullest extent permitted by law, Monument Software Group's total liability arising from this agreement will not exceed the amounts paid by the customer for JobDeck in the twelve months before the claim.

Governing Law and Contact

This agreement is governed by the laws of Arizona, United States, without regard to conflict-of-law rules.
